1. General Provisions
1.1. These Terms and Conditions govern the use of the online music store available at beatwithit.com (“Store”).
1.2. The Store is owned and operated by Fabryka Hitów Emil Toczyski.
1.3. By using the Store, the User (“Customer”) agrees to comply with these Terms and Conditions.
2. Definitions
- Work: A beat or other musical composition available for purchase in the Store.
- License: A legal agreement granting specific rights to the Customer to use the purchased Work.
- Customer: Any individual or entity purchasing Works from the Store.
- Exclusive Licence: A licence granting the Customer exclusive rights to a Work.
- Commercial Use Licence: A licence granting the Customer non-exclusive rights to use a Work for commercial purposes.
3. Purchasing Works
3.1. Works are sold in digital format and made available for download after successful payment.
3.2. Customers must provide accurate and up-to-date information when making a purchase.
3.3. Prices displayed on the Store’s website are in EUR (Euro) and include VAT, unless otherwise stated.
3.4. Payment methods include among others: Google Pay, PayPal, Credit Card.
4. Licensing Options
4.1. Upon purchasing a Work, the Customer must select one of the following licensing options:
4.1.1. Commercial Use Licence
- Non-exclusive rights to use the Work.
- Permitted for use in commercial projects (e.g., music production, videos).
- Attribution to BeatWithIt.com required in all public uses.
- Does not transfer ownership of the Work.
4.1.2. Exclusive Licence
- Grants exclusive rights to the Work.
- Guarantees that no other Customer will receive rights to the Work.
- Includes termination of any existing non-exclusive licences.
- Attribution to BeatWithIt.com required in all public uses.
4.2. The specific terms of each Licence are outlined in the relevant licensing agreement provided upon purchase.
4.3. Customers must retain proof of payment as it, together with the licence document, serves as evidence of the granted licence.
5. Intellectual Property
5.1. All Works offered in the Store are the intellectual property of Fabryka Hitów Emil Toczyski.
5.2. Customers are not permitted to claim ownership, redistribute, resell, or sublicense the Works unless explicitly allowed under the terms of the Licence.
6. Delivery and Refunds
6.1. Works are delivered digitally via download links provided after successful payment.
6.2. Due to the digital nature of the products, refunds are not available once the download link has been accessed.
6.3. If a Customer encounters issues accessing a purchased Work, they should contact support at support@beatwithit.com.
7. Prohibited Uses
7.1. Customers may not use Works in projects that violate applicable laws, promote hate, or incite violence.
7.2. The Store reserves the right to terminate a Licence and take legal action in cases of misuse.
8. Limitation of Liability
8.1. Fabryka Hitów Emil Toczyski is not liable for any claims, damages, or losses resulting from the use of the Works.
8.2. The Store does not guarantee specific results from the use of purchased Works.
9. Amendments
9.1. Fabryka Hitów Emil Toczyski reserves the right to amend these Terms and Conditions at any time.
9.2. Customers will be notified of significant changes via the Store’s website or email.
10. Governing Law
10.1. These Terms and Conditions are governed by the laws of Poland.
10.2. Any disputes shall be resolved by the competent courts in Poland.
